Employment Pass change of employer sequence

An Employment Pass holder changing employer needs a new EP application, while the current employer separately cancels the existing pass at the right time.

An Employment Pass change of employer requires the prospective employer to submit a new EP application. The existing EP does not need to be cancelled before the new application is made. If the new pass is approved, MOM does not automatically cancel the old pass; the current employer must still cancel it at the correct time.

The employee, current employer and new employer should agree the employment dates before either pass is cancelled or issued. Family passes, tax clearance and lawful stay can depend on that sequence.

Treat the move as a new EP application

MOM’s current job-change FAQ says the new employer should apply for a new Employment Pass. The application is assessed on its own merits under the prevailing rules.

For this reason, the prospective employer should check the role, salary, qualifications, company information, Fair Consideration Framework requirements and COMPASS position. An existing EP is not a promise that another employer’s application will be approved.

Keep the new employment contract conditional on the necessary work authorisation. Do not ask the employee to start work for the new employer while only the old employer’s EP is valid.

Apply before cancelling the current EP

MOM states that the current EP need not be cancelled before the new application. This allows the employee to remain employed by the current employer during the notice period while the new application is assessed.

In practice, the new employer or appointed employment agent submits the application. MOM’s EP application guide says online applications are normally processed or given an update within 10 business days, although individual cases may take longer.

Do not set an unconditional start date based only on the normal processing estimate. Build room for questions, additional documents or an appeal decision.

Keep employers’ roles separate

The new employer owns the new application. The current employer owns the cancellation of the existing EP and its employment obligations. The employee should keep both employers informed without sharing confidential documents beyond what each needs.

At the same time, Prepare a sequence note showing the last working day, new-pass approval status, planned cancellation date, intended issue date and family-pass position. Update it when MOM provides an outcome.

A notice period can continue after the new EP is approved. Approval does not itself transfer the employee or end the old employment contract.

Cancel the existing pass at the right time

MOM’s cancellation FAQ confirms that approval of the new pass does not automatically cancel the existing EP. The current employer must cancel it through EP eService.

As a result, the EP cancellation guide says the employer must cancel the pass within one week after the last day of notice and may submit an advance cancellation request up to 14 days earlier. Cancellation is immediate unless it is scheduled in advance.

Do not cancel early merely to pressure the employee or simplify payroll. Settle salary, leave, property return and other employment issues in line with the contract and law.

Plan tax clearance and payroll

MOM tells employers to seek tax clearance from IRAS at least one month before the last day of employment where the requirement applies. The current employer should check the employee’s status and follow the IRAS process.

For example, record the final salary period, benefits, bonuses and stock items. The new employer should start payroll only when the employee is lawfully employed under the new arrangement.

Keep tax clearance separate from the MOM application assessment. A pending clearance does not grant work rights, and a new EP approval does not remove the current employer’s tax duties.

Protect the family’s pass continuity

MOM warns that cancelling the main EP cancels related family passes and they cannot be reinstated. The new employer should identify whether new Dependant’s Pass or Long-Term Visit Pass applications are needed and when they can be issued.

In addition, list every dependant, passport expiry date, current pass and related work authorisation. Do not assume that a dependant’s existing card remains valid after the main EP cancellation.

If anyone will be in Singapore between passes, confirm the lawful stay document and expiry date. A Short-Term Visit Pass is not permission to work.

Complete issuance before work starts

After approval, check the in-principle approval letter, entry or stay position, medical examination if required and issuance documents. The new employer issues the EP through the official service.

For this reason, confirm the digital work pass and any registration appointment. The employee should not rely on an approval email alone when proof of a valid issued pass is required.

Update the employment start date if issuance is delayed. Keep the final timeline with both employment records.

Close the move with clean records

The employee should retain the old cancellation acknowledgement, new in-principle approval and new issued-pass details. Each employer should keep only the records it is entitled and required to retain.
