Check payee residence, payment type, service location, treaty relief and filing dates before paying an overseas company from Singapore.
A Singapore payer should check withholding tax before it pays or credits a non-resident. Start with the payee’s tax residence, the legal nature of the payment and where any services were performed. Then check the domestic rate, any exemption and any treaty relief. The contract should state clearly whether the agreed amount is gross or net of Singapore tax.
IRAS requires filing and payment by the 15th day of the second month after the date of payment. Because the tax point can arise before cash leaves the bank, finance teams need to review invoices, accruals and credit entries rather than relying only on the payment run.
Identify the payee and payment
The IRAS withholding tax overview says specified payments to non-resident companies or individuals can require the payer to withhold and pay a percentage to IRAS. Company residence depends on where control and management is exercised, not simply where the company was incorporated.
Obtain the contract, invoice, payee legal name, country of tax residence and any certificate of residence needed for a treaty claim. Describe the payment according to the rights and work supplied. Labels such as service fee or software fee are not enough when the agreement contains several elements.

Check the main payment categories
IRAS lists interest and loan-related fees, royalties, payments for the use of movable property or knowledge, certain technical and management services, rent for movable property, some real-property payments, structured-product payments and certain REIT distributions among payments that can attract withholding tax. The applicable rate depends on the payment and payee.
Do not apply one rate to an entire mixed invoice. A technology contract may include hardware, a software right, remote support and work performed in Singapore. Review each component using the agreement and actual delivery. If the allocation is artificial or unsupported, obtain advice before payment.
Service location can change the answer
The current IRAS page on taxable payments explains that technical, consultancy and management service fees are generally subject to withholding tax to the extent the work is performed in Singapore. When the non-resident performs the services entirely from overseas through email, telephone or an online presentation without sending staff to Singapore, IRAS states that withholding tax is not applicable to those service fees.
Keep a location schedule for each person who worked on the engagement. Link Singapore days to the service scope and fee allocation. A statement in the contract that work is offshore is not enough if consultants travelled to Singapore and performed part of the assignment here.
Recognise common non-taxable payments
IRAS states that Singapore does not impose withholding tax on dividends. Its non-taxable payment page also describes a waiver for specified payments to Singapore branches of non-resident companies, even though the branch remains taxable on its income.
Software needs careful reading. IRAS distinguishes a payment for software used within the customer’s business, without rights to reproduce, modify, adapt and distribute it, from payments that confer copyright or commercial exploitation rights. Hosting and cloud services are treated as services, with the location of work remaining relevant. Keep the licence terms with the tax review.
Check treaty relief before using a reduced rate
An Avoidance of Double Taxation Agreement can reduce or remove Singapore withholding tax depending on the payment, residence and treaty conditions. The payer must support the claim with the required records. IRAS notes that a withholding tax filing may still be required when a payment is exempt under a DTA.
Record the domestic rate first, then the treaty article, reduced rate, beneficial ownership or permanent establishment analysis and residence evidence. If the contract says the Singapore payer bears the tax, calculate any gross-up before the payment is authorised.
Catch errors before the payment run
Add a withholding tax field to the vendor onboarding form and purchase order. Accounts payable should stop a non-resident payment when the tax review is missing, the service location is unclear or the residence certificate has expired. Procurement should avoid agreeing to a net-of-tax price until finance understands the gross-up cost.
Also review reimbursements, intercompany charges, licence renewals and year-end accruals. A recurring vendor may change its contract, delivery team or tax residence. Copying last year’s treatment without checking the current facts can produce the wrong rate or filing date. A short written review for each material payment is easier to defend than an unexplained code in the accounting system.
Put the due date in the accounts payable process
The IRAS filing page says the due date is the 15th of the second month from the date of payment. IRAS defines the payment date using events that can include actual payment, crediting the payee or another date when the amount becomes due and payable, depending on the circumstances.
For example, a Singapore company credits a royalty payable to its overseas parent on 28 August and transfers the cash on 20 September. Finance should not assume the September bank date controls. It checks the contract, accounting entry and IRAS definition, records the correct tax point, and files and pays by the resulting deadline.
Keep the contract, invoice, tax analysis, residence certificate, treaty support, calculation, filing acknowledgement and payment proof together. Related-party payments should also match the transfer pricing records, while foreign receipts need the separate foreign-sourced income review.
